General terms of sale
The RADLINE brand is the property of SDG Distribution, a simplified joint-stock company with a share capital of 37,000 euros, headquartered at 114 rue des Vanniers, 40150 Soorts-Hossegor, France, registered with the Dax Trade and Companies Register under number 500 510 961, VAT number FR55500510961, telephone number : +33 5 58 70 25 35.
SDG Distribution is a company specializing in the sale of equipment for board sports and outdoor activities.
The products offered for sale on the Website are sold by SDG Distribution (“RADLINE Skateboards Products”).
ARTICLE 1 – SCOPE
These general terms and conditions of sale (hereinafter referred to as "GTC") apply, without restriction or reservation, to all products offered for sale on the Website http://www.radline-boards.com/. Consequently, by placing an order on the Website, the individual or legal entity (hereinafter referred to as the "Customer") fully and unreservedly accepts these GTC.
The GTC will remain in force until a new version is posted. Therefore, before validating any order, the Customer must consult and accept the GTC.
SDG Distribution reserves the right to adapt or modify the GTC at any time. In case of modification, the applicable GTC will be those in effect at the time the order is placed.
ARTICLE 2 – CUSTOMER ACCOUNT
Opening a Customer account and using the Website are free of charge (except for potential connection fees, which depend on the telecommunications provider), with no obligation to purchase. Only product purchases are subject to payment by the Customer.
Access to the Website is strictly personal. When using the Website, the Customer declares that they are acting in a private capacity.
In addition to accepting the GTC, purchasing on the Website requires the creation of a Customer account. The Customer must provide identification information. When opening this account and during each order, the Customer agrees to provide only accurate, complete information corresponding to their identity. The Customer must keep this information up to date and is solely responsible in case of error in the order or delivery due to incorrect information.
To make purchases on the Website, the Customer must use the login credentials and confidential password created when opening the account. The Customer agrees to keep these credentials confidential and not to disclose them to any third party. The Customer is solely responsible for access to their account using their login credentials and password, except in cases of proven fraudulent use not attributable to them.
In case of loss, theft, or fraudulent use of their login credentials and/or password, the Customer agrees to immediately notify SDG Distribution's customer service via the contact form at http://www.radline-boards.com/.
ARTICLE 3 – INTELLECTUAL PROPERTY
The Website, its content, and all its elements are creations for which SDG Distribution holds all intellectual property rights and/or exploitation rights, particularly regarding copyright, database rights, trademark rights, and design rights.
The Website, along with its software, databases, texts, information, analyses, images, photographs, graphics, logos, sounds, or any other data present on the Website, remain the exclusive property of SDG Distribution or, where applicable, their respective owners with whom SDG Distribution has agreements.
Customers are allowed to view data and information on the Website online and may print or save them for a purchase or purchase-related project for strictly private use.
Any other use of the Website, particularly commercial, is prohibited. The Customer must not reproduce or represent for non-private use, sell, distribute, broadcast, translate, adapt, or communicate any element, information, or data from the Website in any form.
Furthermore, the Customer must not introduce data into the Website by any means that could modify or harm its content or presentation. Any hyperlink to the Website must be expressly authorized in advance by SDG Distribution. Additionally, even with express authorization, any such hyperlink must be removed immediately upon SDG Distribution's request.
ARTICLE 4 – PRICING
For deliveries of RADLINE products within mainland Europe, prices displayed on the Website are in Euros, including all taxes (VAT included).
For deliveries outside the European mainland, prices are shown in Euros, excluding any applicable taxes. The Customer agrees to pay any taxes that may be imposed by the destination country, including VAT and any customs duties, which may be collected by the carrier. SDG Distribution cannot be held responsible if the Customer fails to pay these taxes and duties.
The pricing structure is as follows :
- Product prices : These can be changed at any time by SDG Distribution. However, the applicable price will be the one in effect when the order is recorded. The prices listed on the Website do not include shipping costs unless stated otherwise.
- Discounts : Discount vouchers, promotional codes, and loyalty cheques issued by SDG Distribution are not cumulative and are applicable only for RADLINE products.
- Shipping costs : Shipping costs vary depending on the product and the delivery method chosen by the Customer from the options offered by SDG Distribution. These fees are indicated during the selection process and can be accessed at any time under the "My Orders" section of the Website and in the general terms and conditions of sale.
The total amount (product price and shipping costs) indicated in SDG Distribution's order confirmation is the final amount due by the Customer.
ARTICLE 5 – ORDERS
Any order confirmed by the Customer constitutes an irrevocable acceptance of the sales contract, which can only be contested within the limits specified in these general terms and conditions of sale.
The process of placing an order involves two steps (using a “double-click” mechanism) and an authentication procedure, which constitutes validation of the sales contract.
SDG Distribution will acknowledge receipt of the order by sending an order confirmation email to the Customer.
The Customer can consult the details of their order in the “My Orders” section of their customer account. SDG Distribution reserves the right to cancel any order from a Customer with whom there is an existing dispute.
The information provided by the Customer during the ordering process is binding. In the event of an error in the provided details, particularly regarding the email address or the delivery address, SDG Distribution cannot be held responsible for the failure to deliver the product. Any delivery made to the address provided by the Customer will be considered complete.
If reshipping is required due to missing or incorrect information provided by the Customer, the reshipping costs will be charged to the Customer.
If a RADLINE product is unavailable, the Customer will be notified by email, and the order for that specific product will be automatically canceled. The rest of the order remains firm and final. If the payment for the unavailable product has already been debited, the Customer will be refunded. Otherwise, the amount for the unavailable product will not be charged.
ARTICLE 6 – PAYMENT
6.1 – Payment Methods
Payment is made online by the Customer when placing the order. For all products, payment can be made :
- By credit card online (Carte Bleue, VISA, Mastercard, American Express, Bancontact),
- In installments using the 3x 4x Oney reserve system (see Article 14),
- By Paypal.
For each order, payment will be processed by SDG Distribution at the time of order confirmation, covering the price of the products ordered and the shipping costs.
The order confirmed by the Customer will only be considered effective once payment has been received by SDG Distribution.
If SDG Distribution is held liable for damages related to errors in the amounts debited, it may be exonerated from all or part of its liability by proving that the error is attributable to the Customer, an unpredictable and insurmountable action by a third party, or a case of force majeure.
6.2 – Payment Security
Payments made on the Website are fully secured. The banking details provided by the Customer (card number and expiration date) are never transmitted.
Thanks to the encryption software used on the Website, the Customer’s banking details cannot be intercepted by third parties. By providing their banking details, the Customer agrees in advance and without condition to the secure transaction by SDG Distribution. The Customer authorizes their bank to debit their account based on the statements sent by SDG Distribution, even in the absence of a signed invoice. The debit authorization is always given for the amount of the products purchased as invoiced by SDG Distribution.
6.3 – Anti-Fraud Checks
SDG Distribution conducts checks on certain orders and may request additional documents from the Customer to unblock their order.
ARTICLE 7 – DELIVERY
7.1 – Delivery Times and Methods
After the order has been confirmed, the ordered products will be handed over to the carrier selected by the Customer, subject to availability, and unless otherwise indicated to the Customer when placing the order, within a maximum period of twenty-four (24) business hours.
The Customer will be notified by email whenever the products are handed over to the carrier. For SDG Distribution products, the delivery status can be tracked via the Customer’s account.
If the Customer specifically requests delivery to multiple locations, they must place separate orders, with the respective delivery fees applied to each order.
For deliveries within mainland France, the carrier agrees to deliver the order to the address provided by the Customer, within a period of twenty-four (24) to seventy-two (72) business hours. In case of absence, the Customer is typically notified via mailbox, email, or SMS, depending on the carrier selected.
If the delivery is delayed beyond the timeframe agreed upon during the conclusion of the contract, the Customer must contact RADLINE’s Customer Service via their customer account, email, or phone to request delivery within a reasonable additional period.
If delivery is still not made within this additional period, the Customer may request the cancellation of their order from RADLINE’s Customer Service. The order will be considered canceled upon receipt of this request. In this case, the Customer will be refunded the full amount paid within 14 days.
The entire RADLINE team strives to ship each order on the same day or the next morning (business day). The company is not responsible for any delivery failure or delay on the part of the carrier.
7.2 – Receipt
Upon delivery, the Customer is required to sign the delivery note. This delivery note constitutes proof of receipt of the order. The delivery is made to the threshold of the store for street-level businesses or the ground floor for buildings, offices, houses (pavilions), or other premises.
The person receiving the delivery must indicate any concerns on the delivery note in a detailed and precise manner.
In case of visible defects, the Customer has the right to return the products under the conditions provided below.
In case of an issue, the Customer must inform RADLINE’s Customer Service as soon as possible. The Customer retains their right to request the application of legal guarantees.
7.3 – Returns and Exchanges for Non-Conformity or Product Defects
The Customer benefits from legal guarantees of conformity and hidden defects, in accordance with current legal provisions, as mentioned in the "Liability – Guarantees" section.
If the Customer refuses delivery due to incorrect content, non-conformity, or product defects, they must immediately contact RADLINE’s Customer Service by phone or email to determine the applicable return procedure, the return address, and the recipient.
The Customer is informed that "Point Relay" locations are exclusively for collecting ordered goods. "Point Relay" locations are not authorized to accept returns without SDG Distribution’s express agreement. Therefore, the Customer may not return their delivery to a "Point Relay" unless they have received prior written agreement via email from SDG Distribution following the indicated return procedure. If the Customer fails to follow the return procedure and goes to a "Point Relay" without prior agreement, the "Point Relay" has the right to refuse to accept the products.
All items must be returned intact, with accessories and manuals, in their original packaging.
The Customer has the legal time to request a credit or refund in whole or in part, in accordance with Article L.217-10 of the French Consumer Code. The consumer has 2 years from the delivery of the goods to take action.
The consumer may choose between repairing or replacing the goods. As specified in Article L217-9 of the French Consumer Code, the seller may, however, choose a different option than the one selected by the buyer if the choice involves a manifestly disproportionate cost.
The consumer is exempt from proving the existence of the conformity defect within 6 months of delivery. Starting from March 18, 2016, this period will be extended to 24 months.
The legal guarantee of conformity applies independently of any commercial guarantee.
The consumer may decide to implement the warranty against hidden defects of the sold item.
In this case, they can choose between canceling the sale or requesting a price reduction, in accordance with Article 1644 of the French Civil Code.
ARTICLE 8 – TRANSFER OF OWNERSHIP – TRANSFER OF RISK
The transfer of ownership of the products to the Customer will only occur upon delivery of said products.
ARTICLE 9 – RIGHT OF WITHDRAWAL
9.1 – In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen days from the date of receipt of the order to exercise their right of withdrawal, without having to provide a reason or incur any costs other than those specified in Articles L. 221-23 to L. 221-25.
9.2 – The right of withdrawal must be exercised with SDG Distribution for RADLINE products.
To ensure proper handling of the request, it is recommended that the Customer informs SDG Distribution within the specified timeframe and follows the detailed return procedure. To learn about this procedure, please contact RADLINE's customer service via email or telephone.
9.3 – The product must be returned by post, preferably with proof of receipt, to the address indicated in the withdrawal form attached to the GTC.
The product must be sent to this address within fourteen (14) days from the date of withdrawal notification. Return shipping costs will be borne exclusively by the Customer. SDG Distribution is not responsible for lost returns.
9.4 – The product must be returned in perfect resale condition, unused, unassembled, with all accessories, manuals, and in its original packaging. Compliance of the returned item will be checked and validated upon receipt.
9.5 – SDG Distribution will refund the amounts paid by the Customer, excluding return shipping costs.
If the entire order is returned, the refund will include the price of the returned products and the original shipping costs. In the case of a partial return, the refund will include only the price of the returned products, excluding original shipping costs.
The refund will be processed within a maximum of fourteen (14) days. However, the refund may be delayed until SDG Distribution receives the returned item or proof of shipment of the return.
9.6 – In the event of withdrawal by the Customer, when the price of the order subject to withdrawal is fully or partially covered by credit granted to the Customer, the credit agreement is terminated without penalty.
ARTICLE 10 – LIABILITY – WARRANTY
10.1 – SDG Distribution assumes responsibility towards the Customer regarding the products sold, in accordance with the regulations in force.
10.2 – SDG Distribution cannot be held liable for minor variations that may remain despite all precautions taken in the representation of the products.
10.3 – In case of non-compliance, the Customer can choose between repair or replacement of the product. As specified in Article L217-9 of the French Consumer Code, the seller may choose a different solution if the chosen option results in a manifestly disproportionate cost compared to the other option. If repair or replacement is impossible, the Customer may return the item and receive a refund, or keep the item and request a price reduction, in accordance with Article L.217-10 of the French Consumer Code. The legal guarantee of conformity applies independently of any commercial warranty offered by the seller or manufacturer. The consumer has 2 years from the delivery of the goods to take action in case of non-compliance.
10.4 – In the case of hidden defects, SDG Distribution is liable for defects that render the product unfit for its intended use, or that significantly reduce its use, so much so that the Customer would not have purchased it, or would have paid a lower price, had they been aware of the defect. In such cases, the Customer has the choice of returning the product and receiving a full refund or keeping the product and receiving a partial refund. The Customer has 2 years from the discovery of the defect to take action.
10.5 – SDG Distribution cannot be held responsible for non-compliance with regulatory and legislative provisions in force in a country other than France. The Customer is solely responsible for the choice, preservation, and use of the products.
10.6 – Unless the manufacturer is identifiable, SDG Distribution cannot be held liable for damages of any kind, whether material, immaterial, or bodily, resulting from the malfunction or misuse of the products sold. The same applies to any modifications made to the products by the manufacturers. A modified product or one used in extreme conditions will not hold SDG Distribution responsible and the product will not be replaced.
ARTICLE 11 – CONFIDENTIALITY – DATA PROTECTION
These GTC are subject to the provisions of the European regulation 2016/679 of April 27, 2016, concerning the protection of natural persons regarding the processing of personal data and the free movement of such data, as well as the provisions of the French law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, and any other applicable regulations that may supplement or replace it.
Personal data concerning the Customer is necessary for managing orders and commercial relations between SDG Distribution and the Customer. This data includes, for example : Name, Address, Phone Number, Email Address, Credit Card Information, IP Address. Without this information, SDG Distribution cannot provide its service. This data may be shared with companies involved in managing and executing services and orders, for their management, execution, processing, and payment. This data processing has been declared to the French National Commission for Information Technology and Civil Liberties (CNIL), under number 1390007.
This information is kept for security purposes and to comply with legal and regulatory obligations. It may also be used by SDG Distribution to send promotional offers, for statistical purposes, to fight fraud, for legitimate commercial development purposes, and to improve technical systems and customer knowledge. With the Customer’s consent, it may also be used for service personalization, including advertising.
The Customer can unsubscribe from RADLINE’s newsletters at any time by clicking on the link in every email. The Customer also has the option to join the French telephone solicitation opt-out list. Information about this service is available at http://www.bloctel.gouv.fr/.
The Customer can view and modify their personal data in their customer account.
The Customer has the right to access, modify, object to, port, limit, and delete their data, as well as to define directives regarding the fate of their personal data in the event of death, by sending a written request to SDG Distribution, with proof of identity:

ARTICLE 13 – DISPUTES AND APPLICABLE LAW – COMPLAINT HANDLING – MEDIATION
All purchases made through the Website are subject to French law.
Any complaints can be submitted through the contact forms available in the "contact" section, and the Customer will receive a response as soon as possible.
In the event of difficulties in applying the GTC, the Customer has the option, before pursuing legal action, to seek an amicable solution with the help of a professional association in the sector, a consumer association, the European online dispute resolution service (https://ec.europa.eu/consumers/odr), or any other advisor of their choice. If an amicable solution cannot be found, the Customer may contact the CM2C Mediator (Centre for Consumer Mediation) at 14 rue Saint Jean, 75017 Paris, or via https://cm2c.net/.
It is reminded that generally, and subject to court rulings, compliance with the provisions of the GTC relating to contractual guarantees requires the Customer to honor their financial commitments to SDG Distribution.
Any dispute that cannot be resolved amicably will be subject to the jurisdiction of the courts where the Customer resided at the time the contract was concluded or when the damaging event occurred.
